C. § 18-104, the roster of parties eligible to serve as registered agent opens with the limited liability company itself, ahead of resident individuals, qualifying domestic entities, and foreign entities authorized to transact business here. A Delaware LLC can legally hold its own appointment and pay nobody.

The conditions are what settle it for most owners. The company must maintain a registered office at a physical Delaware address, that address must be the agent's own place of business, and someone has to be generally there during business hours rather than nominally reachable. The address becomes public. And the office cannot be a virtual suite or a mail-forwarding account, which is precisely what a company managed from outside the state would have to use.

So the honest hierarchy runs like this. If you operate a staffed office in Wilmington or Dover, self-appointment is a lawful way to spend nothing at all, and we would rather tell you that than sell around it.
